Terms of Service

These Terms govern your use of Salma (the “Service”) at salma.fit and app.salma.fit. By using the Service you agree to these Terms. “Customer” means the clinic or business that subscribes; “Patient” means an individual who messages a clinic through Salma.

1. The Service

Salma is an AI healthcare operation manager: a patient-facing AI receptionist and an in-dashboard staff assistant that triages symptoms, books appointments and manages patient communication across channels. The Service is provided on a software-as-a-service, multi-tenant basis.

2. Eligibility & authority

You must be able to form a binding contract and have authority to act for the clinic. You represent that you have the rights and consents to send patient data through the Service and to connect the channels you configure (e.g. your own WhatsApp Business Account).

3. Your accounts & credentials

You are responsible for your clinic’s account, the credentials you connect, the roles you assign, and the data you send. Protect your access; you are responsible for activity under your account.

4. Acceptable use

You will not use Salma to send unsolicited spam, unlawful, abusive or deceptive content, or to process data you have no right to process. You will comply with the platform policies of each channel you connect (Meta/WhatsApp, Telegram, Instagram, Facebook, Twilio) and with applicable healthcare, privacy and consumer-protection law.

5. Healthcare & clinical responsibility

Salma is an operations and communication tool, not a medical device and not a substitute for clinical judgment. Salma does not diagnose, treat or prescribe. Clinicians remain responsible for all clinical decisions. Emergency triage signals are escalation aids, not clinical determinations.

6. Data & privacy

Your use of the Service is governed by our Privacy Policy and your applicable Data Deletion obligations. You are the controller of patient data; we process it on your instructions.

7. Fees & usage

Fees, credits and usage limits are as agreed when you subscribe or as displayed in the dashboard. You are responsible for third-party channel and LLM provider costs your configuration incurs. Credits may apply per-clinic; usage caps help prevent runaway spend.

8. Service availability

We strive for high availability but do not warrant uninterrupted service. Maintenance, third-party outages and force majeure may affect availability. We may update or change features with reasonable notice.

9. Intellectual property

We retain all rights in the Service. You retain all rights in your data. We may use aggregated, de-identified analytics to improve the Service, never in a way that identifies a patient or clinic.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” without warranties of any kind. We do not warrant that the Service will be error-free or meet your specific requirements.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim is limited to the amount you paid us in the preceding 12 months, and we are not liable for indirect, incidental or consequential damages.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach, non-payment, or to protect the platform. Upon termination, your data is handled per the Privacy Policy retention and deletion terms.

13. Use of data for product improvement & AI training

With the Customer’s consent (given in the dashboard or in your service agreement), Salma may use de-identified and aggregated data derived from your use of the Service to improve, develop, and train Salma’s models and products. “De-identified” means the data can no longer reasonably be used to identify a patient or clinic. We will not use identifiable patient health data to train AI models without your separate, explicit consent and a lawful basis. WhatsApp data received through the Meta WhatsApp Business API is excluded from any training use, as required by Meta’s terms. You may opt out of any such use at any time by emailing privacy@salma.fit.

14. Changes to these Terms

We may update these Terms. Material changes will be posted with an updated date. Continued use after changes constitutes acceptance.
